OFWs' headaches in buying Philippine properties

MANILA, Philippines—Buying property on impulse may cause more regrets in the end.

An industry legal expert has estimated that 50 percent of buyers of house and lots and condominium units had admitted they could no longer pay their monthly amortizations or were dissatisfied with particular aspects of the project, and were asking for refunds of their payments.

Mike Denava, legal officer of the Housing and Land Use Regulatory Board, told Inquirer Property that he based this on callers asking for assistance at the HLURB hotline.

He added that some of these callers were overseas contract workers who could no longer find jobs abroad.

This has prompted Denava to enumerate to Inquirer Property the following 15 reminders to potential property buyers.

1. Check the source of your income. Aside from checking the development projects thoroughly, look at your own resources on a long-term basis to be certain if you can really pay your monthly amortizations in the long run.

2. Check if the project has a license to sell and if it is registered with the HLURB.

3. Check if the broker or agent is registered.

4. Check if the property is not yet sold to others.

5. Conduct personal visits to the project site. It is also advisable to visit the property itself to check for leaks or potential for flooding.

6. If you’re buying on pre-selling terms, look at the date of completion of the project, which should be found in the developer’s license to sell.

7. Check if the property is mortgaged. If it is, make sure there is clearance from the HLURB.

8. Check if the materials used in your prospective home conforms with the standards approved by the HLURB. It is indicated in the approved plan. The local government approves the plan for subdivision projects, while the HLURB approves plans for condominiums. HLURB grants certificates of registration and licenses to sell to developers applying for project approvals.

Denava also said approval of subdivision projects also includes the assurance of safety measures. Mandatory requirements, particularly in condominium units, include certificates of fire protection, occupancy permits and mechanical certificates.

9. Make it clear who should be responsible for paying the cost of water and electric meters.

10. Check whether subdivision perimeter fences will be provided. If it is not in the approved plan, a buyer cannot demand the developer to put perimeter fences.

11. Do not sign a blank contract to sell.

12. Read the contract to sell thoroughly, especially the fine print.

13. Secure a copy of the contract to sell and of the other documents that you have signed.

14. Make sure the contract to sell will be registered with the Register of Deeds (the developer is mandated to do this).

15. Pay directly to the owner-developer and/or authorized marketing agents, and make sure to ask for official receipts as soon as they get your payment.

How to buy property, info found on the internet

A lot of smart and resourceful young investors find a lot of information on the internet about How to Buy Property in Philippines. I would do the same to get a basic idea on how lucrative buying Philippine properties could be. However, as I did a lot of research, I found critical loopholes and inconsistencies:

1. Information on the internet contain bits and pieces of laws that are "always" subject to interpretation.
2. Information on the internet are given away for free as they have been derived from other internet articles, mostly written by local real estate agents from Philippines. Their goal is to "sell" their listings.
3. Information on the internet still need to be critically analyzed and mostly not intended to make sure foreign investors maintain control over the property.

The Philippines was arguably the worst effected by the 1997 Asian financial crisis, with the biggest drop in property market, and has not yet managed to recover fully to this day. Despite this, with a predicted GPD growth of 7.4% in 2007, the Philippines' economy is strongly growing in both Manila and Cebu City. A growing trend in the economy in 2004 [15] resulted in a small property boom, where all office space, luxury residential and retail markets are still on the rise. This is surprising as Philippines is still perceived as an un-desirable place to do business in Asia [16] although there are plenty of professionals coming into the country and joining the expatriate community. Economic growth is heavily reliant on private consumption and investment. There are 8 million overseas nationals who continue to invest into property in the Philippines, but growth may be vulnerable due to the recent 10% depreciation of the US dollar against the Peso. Manila's CBD (Central Business District), Makati City, is the most expensive district in the city for office space. On the contrary, Manila still remains to be one of the cheapest places in Asia to buy luxury residential property. A recent surge in supply for this will trouble the market and pervious investors within the next few years.

Philippine Real Estate: What OFWs and Expats Should Watch Out For

Many OFWs and foreigners are encouraged to purchase property due to the surge of low cost housing, usually by unscrupulous developers.

The Philippine Property Market has grown tremendously over the past 5 years. In fact, RP real estate industry grew an all time high of 17% in 2007. This is mainly driven by internet marketing, increased tourism, increased remittances from OFWs and foreign investments. Many OFWs and foreigners are encouraged to purchase property due to the surge of low cost housing, usually by unscrupulous developers. The main attractions for buying properties in Philippines are: low cost of living, cheap properties, scenic views and friendly people. However, this flourishing industry is abused by real estate sales agents and real estate developers in Philippines.

All over the internet, there are numerous listings of low cost properties. Hundreds and thousands of flyers are distributed in malls, hotels and tourist destinations in Philippines. However, a great many of these real estate developers and real estate salesmen in Philippines do not have the proper certificates and licenses to operate or sell property.

There have been many reports of Filipino Overseas Workers who have been swindled by gutless real estate developers in Philippines. The brochures and flyers of these developers showcase lovely homes, colourful promises. Notice that they also have disclaimers that say “This brochure is developed based on artist interpretation. The developer reserves the right to alter property details without notice…” and so on. Foreigners and OFWs who are interested in buying properties in Philippines should be careful not be lured into these properties. They are advised to look for a HLURB seal or license number. The Housing and Land Use Regulatory Board is a quasi-judicial sector of the Philippine Government who controls and regulates all the sale, lease, listing, advertising and any activity relating to the purchase of housing, land and condos in Philippines. If you do not see this seal or license, please report to HLURB Cases and Other Legal Matters: 924-3367.

Foreigners and OFWs who are interested in buying or selling property investments in Philippines should also try to look for a reliable and licensed real estate broker. There are so many unlicensed sales agents on the internet that do not even have a license or do not have an affiliation with a brokerage in Philippines.

Investing in Philippines might prove to give high returns of investment – but only after due diligence.
